IMPORTANT INFORMATION REGARDING THE ISUZU EMISSIONS CLASS ACTION

This statement concerns the Isuzu Emissions Class Action, being Federal Court of Australia proceeding no. NSD 1109 of 2024.

Isuzu UTE Australia customers may have recently received an Opt Out Notice issued by the Federal Court of Australia in relation to this class action concerning certain Isuzu D-MAX and MU-X vehicles.

This statement provides general information only and is intended to clarify Isuzu UTE Australia’s limited role in the class action and to address common questions arising from the court-issued notice.

WHAT IS THE CLASS ACTION?

The class action has been brought by two lead applicants against Isuzu Motors Limited, a Japanese public company. The lead applicants are represented by the law firm Piper Alderman. The class action relates to alleged compliance issues and emissions technology allegedly fitted to certain D-MAX and MU-X models. Isuzu Motors Limited denies these allegations.

The claim has not been brought against Isuzu UTE Australia, which distributed those models in Australia.

The Opt Out Notice you may have received will explain the nature of the claims, the options available to you if your vehicle is an affected vehicle, and the steps you may take if you wish to remain a group member, register for updates, or opt out of the class action.

HOW DID PIPER ALDERMAN OBTAIN MY CONTACT INFORMATION?

Isuzu UTE Australia was ordered by the Court to provide some customer information to the Court, including contact details. However, the Court ordered that this information could only be used for the limited purpose of sending Court-approved notices, such as the Opt Out Notice.

Except for the purposes of complying with the Court’s order, Isuzu UTE Australia has not provided any personal information to the Court or to the parties included in the litigation.

MY VEHICLE FALLS IN THE RELEVANT DATE RANGE, IS IT SAFE TO OPERATE?

Yes. The Isuzu Emissions Class Action relates to alleged emissions compliance issues, not vehicle safety.

Isuzu Motors Limited denies the allegations relating to compliance issues.

ARE THERE ANY INSPECTIONS OR CHECKS THAT SHOULD BE DONE AT THE DEALERSHIP TO CHECK WHETHER MY VEHICLE IS AFFECTED BY THE ALLEGED COMPLIANCE ISSUES?

No. There are no specific checks required. Vehicles can continue to be operated and serviced in the normal way.
