Isuzu UTE MAX RUN CHALLENGE 2011 (“Promotion”)
 
Prizes:
  • Major Prize: A brand new Isuzu D-MAX X-RUNNER 4x2 crew cab ute manual  (national drive away price $37,490 which includes one year’s registration and on-road costs for any Australian state of territory, the vehicle to be collected by the winner from the Isuzu UTE dealer nominated in the entrant’s entry form as nearest); a selection of camping and fishing gear courtesy of Boating, Camping Fishing (“BCF”) (recommended retail price $11,000); one year’s supply of MOTHER Energy Drink (recommended retail price $1,000);
  • Minor Prizes: a weekly prize consisting of $150 worth of merchandise from Isuzu Ute and/or its promotional partners BCF and MOTHER.
  • Total prize pool value: $51,290.
 
Conditions:
  1. Entry for the Major Prize is via an online entry form accessible at   www.isuzuute.com.au.
  2. Only one entry per person is permitted for the Major Prize and only one successful entry per person per week for the Minor Prizes.
  3. The entry form will require the entrant’s name, address, mobile phone number and email address, and the name of the nearest Isuzu UTE dealer.
  4. The Major Prize winner will be the person who estimates to the nearest second decimal place fraction of a litre how many litres of diesel fuel  an Isuzu D-MAX X-RUNNER 4x2 crew cab ute manual will have used when driven by the Promoter’s nominated expert economy driver and co-driver over the route generally described and/or depicted in various promotional material as starting in suburban Melbourne, Victoria, and finishing in Cairns,  Queensland.  For the avoidance of doubt, the Major Prize will be a brand new vehicle, not the actual vehicle used in this challenge. 
  5. Fuelling verifications will be conducted at the start location, various other locations along the route and at the finish, each time by a representative of a contractor to the relevant state/territory motorist association/club or other responsible person, who will supervise fuelling procedure, formally witness in writing fuel volume  intake and relevant odometer readings and seal and break numbered security seals on the vehicle’s fuel filler flap at such fuelling locations.
  6. The Major Prize winner will be announced at 4pm AEST on 03/06/11.
  7. In the event that two or more entrants submit the same closest estimate for the litres used, the Major Prize winner will be determined by a random draw of those entrants to be conducted at 3pm AEST on 03/06/11 at the Promoter’s premises, 921 –929 Kingsford Smith Drive, Eagle Farm QLD 4009. 
  8. The first initial, surname and State/Territory of the Major Prize winner will be published in The Australian newspaper on 08/06/11. The Major Prize winner will be notified by email and telephone.
  9. The promotional period commences at 9am AEST on 8/3/11 and final entries close at 4pm AEST on 31/5/11(“Promotional Period”).
  10. In addition to entering the Major Prize, entrants will be able to complete a different quiz online each week at www.isuzuute.com.au during the Promotional Period.  All entrants who complete a quiz will go into a weekly draw for Minor Prizes.  All Minor Prize winners will be drawn at random from a computer database at 4pm AEST  03/06/11 at the Promoter’s premises, 921 –929 Kingsford Smith Drive, Eagle Farm QLD 4009.
  11. The first initial, surname and State/Territory of all Minor Prize winners will be published in The Australian newspaper on 08/06/11. Minor Prize winners will be notified by email and telephone.
  12. Prizes are not transferable nor redeemable for cash.
  13. The promoter is Isuzu UTE Australia Pty Ltd ABN 80 129 563 739 of 921 –929 Kingsford Smith Drive, Eagle Farm QLD 4009, Phone:07 3113 5888 (“Promoter”). 
  14. Information regarding how to enter, how to claim and details of prizes form part of these conditions of entry. Entry into this Promotion is deemed to be acceptance of these conditions of entry.
  15. Entry is only open to Australian permanent residents aged 18 years or over, excluding the directors, management and employees of the Promoter and its related companies and agencies (and their immediate families).
  16. Incomplete or indecipherable answers by entrants will be deemed invalid. The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every participant. No correspondence will be entered into.
  17. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.  In the event that an error occurs, the Promoter accepts no responsibility for costs incurred, responses received or any other consequences.  The winners of prizes must notify the Promoter if their contact details change during the Promotional Period.
  18. The Promoter may require winners to validate their details at any time prior to being eligible to claim a prize. The Promoter reserves the right to request winners to provide proof of identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
  19. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any written directions of any relevant authority.
  20. The Promoter reserves the right, in its sole discretion, to disqualify entry from any person, and prohibit that person's further participation in this Promotion, who tampers with, or benefits from any tampering with, the process or the operation of the Promotion, acts in violation of these terms and conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.
  21. In the event of any prize not being accepted or claimed within 3 months of the completion of the Promotion, the Promoter reserves the right to conduct such further draws at 4pm AEST on 5/9/11 at 921 –929 Kingsford Smith Drive, Eagle Farm QLD 4009.All winners of unclaimed prizes will be notified as soon as practicable after they have been drawn by mail and telephone with details of how to claim their prize. The names and state/territory of residence of the winners of any unclaimed prizes will be published in The Australian on 9/9/11.
  22. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered (including but not limited to that arising from any person's negligence) in connection with this Promotion and/or any aspect of any prize, except any liability that cannot be excluded by law in which case that liability is limited to the minimum allowable by law.
  23. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transfer of prizes.
  24. The Promoter and their associated agencies and companies accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of the competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
  25. All entries will be the property of the Promoter. The information selected entrants provide will be used by the Promoter for the purpose of conducting this Promotion and to contact entrants that have opted in for offers and promotions or information regarding the Promoter’s products or those of its promotional partners (BCF and MOTHER) or associated companies and agencies. The Promoter may disclose selected entrants’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with selected entrants and to State and Territory lottery departments and winners' names may be published as required under the relevant legislation. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. By contacting the Promoter, entrants can request access to the personal information the Promoter holds about them and/or request not to be contacted by the Promoter and/or its associated companies or agencies for marketing purposes.
